Tatyana Ruderman counsels and advises clients on privacy, data security, and other consumer protection laws, including drafting consumer policies, disclosures, and public-facing statements, steering cookie management tool functionality and design, leading data mapping and inventory efforts, guiding internal compliance on data management, minimization, and retention and expanding consumer rights, and reviewing and negotiating third-party contracts. Tatyana’s practice often involves navigating evolving technology matters (such as involving cryptocurrency and blockchain, online advertising and analytics practices, precise geolocation, biometricsand other sensitive data, AI, recording), including auditing and providing feedback on design of beta pilots and implementing policies and contracts relating to e-commerce and integrated and connected products and platforms.
Tatyana also advises clients on marketing and advertising and intellectual property issues, including those involved in consumer sweepstakes, contests, and other promotions, social media, collection and use of user-generated content, and email/call/text message campaigns.
Tatyana joined InfoLawGroup as Counsel in May 2018. Tatyana previously served as a Senior Associate at Mudd Law Offices, where she represented local and international clientele in diverse litigation and transactional matters involving Internet, privacy, entertainment, intellectual property, startup, employment, contract, and tort law matters. Tatyana quickly developed experience in the area of Internet law. As a second-year associate, Tatyana argued before the Illinois Appellate Court on the issue of Illinois courts’ jurisdictional limits for compelling discovery of personally identifying information. As a fourth-year associate, Tatyana led an online defamation jury trial.
Counsels on “privacy by design” and issues related to the collection, use and sharing of personal information, as well as developing of client websites and applications for consumer-facing and business-to-business companies, including auditing websites and advising online advertising and targeting practices, and drafting Terms and Privacy Policies and real-time disclosures.
Spots risk and advises clients on privacy, advertising/marketing, and intellectual property issues involving emerging technologies and industries, such as blockchain technology and cryptocurrency, collection and use of sensitive data, including geolocation and biometric data, and artificial intelligence (AI) and automated processing and decision-making technology.
Negotiates and drafts agreements for entertainment industry clients, including screenwriter, director, photographer, and other artist agreements
Advises on marketing and privacy compliance issues in the alcoholic beverage industry, involving complex legal research and analysis
Advises clients on compliance with the California Consumer Privacy Act of 2018 (CCPA) and Attorney General regulations implementing the CCPA, the California Privacy Rights Act (CPRA), Virginia Consumer Data Protection Act (VCDPA), and other new state privacy laws.
Keeps clients informed of other evolving privacy-related state and federal legislative efforts, including leading data-mapping efforts, drafting and implementing internal and consumer-facing policies, processing and responding to consumer rights requests, managing third-party relationships with vendors and other business partners, and providing overall guidance on compliance programs.
Advises on issues related to offering content and streaming services, including compliance with the Video Privacy Protection Act (VPPA).
Advises on consumer messaging campaigns (emails, calls, texts), including compliance with CAN-SPAM, TCPA, FCC orders and carrier requirements for calls and text messages.
Prepares trademark and copyright filings, respond to Office Actions, and other USPTO proceedings, including trademark oppositions.
As a former litigator, managed speech and privacy-related cases from inception to disposition, including cases involving claims for defamation and false light, as well as those brought pursuant to the Computer Fraud and Abuse Act, the Stored Communications Act, the Electronic Communications Privacy Act, and the Illinois Eavesdropping Act.
