Trademarks and Domain Names

We partner with clients of all sizes to identify and protect key brand and product names.  We work with those who are expanding to new product categories or new territories for distribution or manufacture to optimize the scope of protection for their marks, and we manage large trademark portfolios to ensure wholistic trademark portfolio governance.   Our services include trademark clearance and all aspects of application prosecution and post-registration maintenance, as well as counseling regarding reasonable domain name registration and maintenance programs.  We further oversee trademark counsel throughout the world in their performance of similar work for our clients.

Copyright

We assist clients in both acquiring and protecting content, including assisting with rights clearance and filing for and obtaining copyright registrations.  We counsel clients on the use of third party content including user-generated content, as well as the best ways to take advantage of the unique protections afforded by the Communications Decency Act (CDA) and DMCA. 

Right of Publicity

We advise clients on right of publicity issues, including rights management, usage and clearance of names, likenesses, voices and images for use in content and advertising.

Licensing and Contracts

We draft and negotiate a wide variety of contracts affecting trademarks, copyrights, and rights of publicity, including content and software licensing, design collaboration agreements, releases and other short-form permissions, assignments of rights, and website terms of use. 

Enforcement

We support our clients by monitoring for infringement of their rights and by enforcing – and defending where necessary – their rights.  We represent clients before the Trademark Trial and Appeal Board, assist clients with enforcement via the Uniform Domain-Name Dispute-Resolution Policy (UDRP), and manage cease and desist letters and takedown requests.
